Acceptance of Terms
By Visiting or using dvdstore.au (“the Site”) you (“the User”) agree entirely to these Terms Of Service. If you disagree with any or all of the terms, you must immediately discontinue your use of the Site.
1. Copyright
All content on the Site inclusive of its text, logo, website design, and product information is the property of either Solandis Media or its respective copyright owners. Solandis Media does not claim to own the copyright of all aspects of the Site. You must not use any materials on this site in a way that is not permitted by Solandis Media including reproduction or distortion. Doing so may result in termination of access or legal action.
2. User Responsibilities
As a user of the Site, you are responsible for providing accurate information to Solandis Media concerning any services the Site provides. This includes but is not limited to Name, Shipping, and Contact Information. Solandis Media will not be held liable for any and all suits, claims, demands, losses, penalties, and other costs sustained by the User as a result of providing inaccurate information. Nothing in these Terms limits your rights under the Australian Consumer Law, including statutory guarantees for goods and services. If you have provided inaccurate Order Information please provide notice as soon as possible using the Support page. If you have provided inaccurate information not relating to an Order, please use the Contact page.
3. Provision Of Goods
Solandis Media will supply all goods to the delivery company in good order. If the goods are damaged in transit, you must provide a photograph of the damaged goods and notify Solandis Media within 15 business after the order has been dispatched to receive a full refund.
4. User Security
Users are entirely responsible for their own security measures while Solandis Media is responsible for its infrastructure security. Solandis Media recommends the use of legitimate antivirus software, strong account passwords, and relevant education on cyber security practices.
5. Payment Processing
Solandis Media utilises third-party payment providers (PayPal & Stripe) to offer payments for its online stores. It does not store payment card details.
6. Prohibited Activities
In your use of the Site, you must not take any action that could harm Solandis Media its operations, or its reputation. You must not
- Use abusive language or threats towards any owners or employees of Solandis Media
- Violate laws, infringe intellectual property rights, or disrupt the Site’s functionality
- Engage in fraudulent activities or generate Spam (Unauthorised Marketing Materials)
- Attempt Unauthorised access to any systems or data within Solandis Media
In the event you engage in any of these activities, Solandis Media reserves the right to terminate the provision of its products or services to you. It will not be held liable for any resulting outcomes of the termination and may take legal against you. You will receive a warning if your behavior is found to be abusive or threatening before any termination occurs.
Nothing in these terms restricts your right to provide honest feedback, reviews, or complaints about your experience with Solandis Media, given such statements are truthful and lawful.
You agree to comply with all applicable laws when using the Site.
7. Limitation Of Liability
To the fullest extent permitted by law, Solandis Media provides the Site and its content with transparency and strives for continuous improvement, while acknowledging that all services are offered without guarantees beyond those explicitly required by law. Solandis Media maintains a commitment to minimising disruptions and errors, but will not be held liable for incidental issues arising from normal Site use, consistent with applicable legal standards.
8. Force Majeure
(a) Definition
Solandis Media shall not be liable for delays or failures to perform obligations under these Terms if caused by circumstances beyond its reasonable control, including but not limited to:
- Natural disasters (e.g., bushfires, floods, cyclones)
- War, terrorism, or government actions
- Pandemic/epidemic health orders
- Critical infrastructure failures (power grids, internet outages)
- Labour strikes or supplier collapses
(b) Communication Limitations
Where a Force Majeure event prevents written notification to affected users:
Solandis Media will attempt alternative communication methods (e.g., website banners) if reasonably possible
Failure to notify individual users due to the Force Majeure event itself will not constitute a breach of these Terms
(c) Termination Rights
Either party may terminate affected orders if the Force Majeure event:
Continues for more than 30 days, and Makes performance commercially impossible
(d) Consumer Rights
Nothing in this clause limits:
- Your right to a refund for undelivered goods/services already paid for
- Statutory Guarantees under Australian Consumer Law
9. Modifications to Terms
Solandis Media has the right to update or modify these Terms at any time. The revised Terms will be effective immediately upon posting to the Site with the last updated date indicating the last revision. By continuing to access or use the Site after such changes, you agree to be bound by the revised Terms.
10. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision shall be modified to the minimum extent required to reflect the parties’ original intent while complying with applicable law.
11. Termination
Solandis Media maintains the right to suspend or terminate access to the Site for violations of these Terms or at its sole discretion.
12. Governing Law
These Terms are governed by the laws of Australia. Disputes will be resolved in the courts of Victoria.
